Ebkar Vendor Terms and Conditions

1. About Ebkar: Ebkar Service is developed and operated by Elite Software (Elitesoft). Elitesoft is a UAE based company. Ebkar service is currently available in UAE only. Ebkar facilitates online ordering between any store based in UAE (referred to as vendor) and consumers based in UAE. Delivery is the responsibility of the vendor. These Terms and conditions govern the relationship between Elitesoft and the vendor which this app is intended to.
2. Security: You must ensure that the log-in details and your password are kept confidential, and that the Platform is only accessed by a responsible member of your business.
3. Products list: All products information must be accurate and always kept up to date.
4. Prices: The declared item prices are your sole responsibility.
5. Governing Law and Jurisdiction:

• you must always adhere to all applicable UAE laws.
• Any purchase, dispute or claim arising out of or in connection with Ebkar service shall be governed and construed in accordance with the laws of UAE

6. Content: Always make sure to post the best photos, correct description, and prices. You are fully responsible for any content published on the Platform.
7. Prohibited items: Absolutely no tobacco, alcohol, or pork products or any products that are prohibited in Islam shall be listed.
8. Delivery area: You must only select the delivery area that you are able to properly serve.
9. Delivery charges: you have the right to waive or set any delivery charges as desired.
10. Service charge: This service if free while the store/restaurant is still indicated as “coming Soon”. The cost thereafter shall be as indicated in the vendor app and shall apply per completed order. Any revision of the fee may be notified 1 month in advanced.
11. Ebkar global product database: Stores can select database any product from Ebkar global product database.
12. Service quality: You must keep the Ebkar vendor app always online and always connected during business hours, with reasonably fast response and delivery time for all orders. Elitesoft reserves the right to put any Business offline in case of high order timeouts or high number of cancellations.
13. Liability: you are fully responsible for the accuracy of all prices, price totals, and any loss of revenue that is caused by pricing mistakes.
14. Monthly Settlement:

• On monthly basis, Ebkar service charges are to be settled as per the online statement. On failure of settlement, your store will be put offline until the bill is settled.
• All Ebkar service charges are inclusive of VAT.
• The online payment can be made using Visa and MasterCard credit/debit card in AED 
• All payments on Ebkar platform are manually triggered by the user. There will absolutely be no automated triggered payments.

15. Cancellation policy: you may opt to stop the service at any time without any obligations
16. Refund Policy: 

• Ebkar Service is based on monthly billing and monthly subscriptions; therefore, refunds are not applicable except in the occasion of technical error, which needs to be looked at case by case.
• In case of a refund is applicable, refunds will be done only through the Original Mode of Payment

17. Privacy Policy: 

• “All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties”.
• Ebkar Vendor App Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, you are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted”.
